Customer Privacy Statement

This privacy statement (‘Statement’) explains how Foodz & More B.V. (“JET”, “we”, “us” or “our”) collect, use, disclose and otherwise process personal data. The Statement applies to the processing of personal data of customers who use any of our platforms and products, including the ordering website, the app, the platform and the products, the JET platform, the JET products and the services for companies from JET (“JET for Business”) (collectively, the “Services”) to place orders with a restaurant partner, supermarket, grocery store or other business partner (“Partner(s)”) that offers products or services for delivery through our Services.

We may use your personal data to fulfill orders placed on the Partner’s website, application or ordering platform. In such circumstances, we will process data received from such Partner(s) in accordance with this Statement.

This Statement also applies to the processing of the personal data of all customers, assigned employees and users who use any of our JET for Business products and platforms.

At JET, we are committed to protecting the privacy of everyone in our community.

Which personal data we process and why

Personal data, also referred to in this Statement as “your data”, refers to any information or set of data that allows us, directly or indirectly, to identify you personally, in particular using an identifier, e.g. first and last name, email address, telephone number, etc. Personal data does not include data from which the identity has been removed (anonymous data).

When you interact with JET through our Services, we collect and process your personal data. JET may process your personal data for the following purposes:

1. Order Process

We process the personal data that you provide to us when you place your order. These personal data are necessary to process your order, confirm your order and to assess your order, payment and a possible refund. Your information (such as the items you add to your shopping cart) allows us to process your order and send you an accurate invoice. This information also enables us or any Partner you order from to contact you where necessary. Some Partners on our platform use our third party delivery companies who may use your information to provide you with status updates regarding the delivery of your order. Depending on the circumstances, we may rely on your consent or the fact that the processing is necessary to fulfill a contract with you or to comply with the law. We may process the following personal data during the ordering process:

As part of our Services, we may sell products through our Partners that may reveal sensitive personal data, such as health-related information (allergies or dietary requirements), information about your religion (for example, whether you eat only halal food), information about your medical condition (e.g. medicines, medical devices, medicated creams, nutritional supplements, herbs or homeopathic products) or about your sexual orientation. As part of your order, we will collect and process this data with your consent.

We may engage in the sale and delivery of limited products or services. In order to comply with our legal obligations imposed by applicable law, we may apply verification procedures for the sale and delivery of these products, including verification of your age and identity. For this purpose, we may ask you to present a valid government-issued identification document and JET will have no obligation to perform and complete its Services if you do not cooperate with the required verification procedure.

2. Reviews about partners and delivery providers

After your order, you may be asked for a review of the Partner or delivery person. We may also offer you the opportunity to submit a review about Partners and/or delivery providers. Depending on the circumstances, we may rely on your consent or the fact that the processing is necessary to fulfill a contract with you or to comply with the law.

JET processes the personal data you provide when submitting a review. You can withdraw your consent by contacting us. We may process the following personal data when you post a review about the Partner and/or delivery person:

  • Contact details
  • Judgement

When your review is published, the review and your first name may be made available to deliverers, Partners and/or the public.

3. Customer service

When you contact our customer service, we use the personal data you provide to answer your question or handle your complaint. We may collect personal information in the context of call recordings to provide customer service, including to investigate and address user concerns and to monitor and improve our customer service responses and processes.

We may also collect your personal data if you submit a notification to us regarding the presence of an item on our Services that you suspect is ‘illegal content’ as defined in the EU Regulation 2022/2065 of the European Parliament and the Council (“Digital Services Act”), but also to provide you with access to an internal complaint handling system and/or to take required suspension measures and provide protection against misuse of our Services as required by the Digital Services Act.

Depending on the circumstances, we may rely on your consent or the fact that the processing is necessary to fulfill a contract with you or to comply with the law. We may process the following personal data for customer service purposes:

4. Customer accounts

When you interact with our Services, you will be given the option to create an account with us via our platforms or via third party social login portals (e.g. Apple, Google, Facebook Connect or other platforms) where the privacy statement of the relevant third party will be displayed in addition to this Statement also applies to you. If you do not wish to create an account with us, we also offer you the option to continue with a temporary guest account to complete your purchase with us. Depending on the circumstances, we may rely on your consent or the fact that the processing is necessary to fulfill a contract with you or to comply with the law. You can withdraw your consent and/or delete your account by contacting us. Revoking or deleting your account may negatively impact your user experience. We may process the following personal data for the customer account:

5. Loyalty Programs (in applicable markets)

JET has several loyalty programs to offer you offers and discounts. When you use one of our loyalty programs, we process your personal data to provide you with the discounts or offers set out in the relevant loyalty program. Depending on the circumstances, we may rely on your consent or the fact that the processing is necessary to fulfill a contract with you or to comply with the law. One of our loyalty programs is the loyalty shop, where you can pick up offers from external partners. Some loyalty shop partners need your personal data for shipping purposes. We may process the following personal data for the loyalty shop and the shipping of your order:

6. Customer research

To ensure that our Services are in line with your preferences and to improve our Services and platforms, JET may contact you to conduct customer research; such as, but not limited to, surveys. We will only send you these types of communications with your prior consent, unless this is not necessary under applicable law. Participation in customer satisfaction surveys is completely voluntary. If you do not wish to receive these surveys, you can unsubscribe in the messages themselves. JET may process the following personal data for research purposes:

7. Marketing

We also process your personal data to send you (personalized) marketing communications and notifications to manage, support, improve and develop our Services. Such messages may include the latest news, discounts and updates about new Partners and other communications involving direct marketing. We rely on your consent unless your consent is not required under applicable law. If you would like to change your preferences regarding receiving such communications, you can unsubscribe via the unsubscribe link in the communications, in your account settings or by contacting us. There may be cases where JET may process your personal data to promote third party offers, products and services. The legal basis for this processing of personal data is your consent, unless your consent is not required under applicable law. If you would like to change your preferences regarding receiving such communications, you may unsubscribe via the unsubscribe link in the relevant communications in accordance with applicable law or opt out of communications via SMS by replying “STOP”. You can also refuse marketing messages sent via push notifications by denying the relevant consent for our app in your phone or tablet settings. However, this also means you will not receive order updates via push.

8. Cookies

JET uses cookies or similar technologies for functional, analytical and marketing purposes. Data processed for cookie purposes is broken down by purpose (functional, analytical or marketing) and depends on the preferences set by you.

Please note that disabling cookies may deny you the ability to use certain Services and/or features on the website or may impair your user experience.

9. Fraud Prevention

We also process personal data to prevent fraud and other forms of abuse on and through our Services. Depending on the circumstances, we may rely on your consent or the fact that the processing is necessary to fulfill a contract with you or to comply with the law. 10. Analytics

JET uses your personal data to improve our website and our range of products and Services and to comply with our reporting obligations to third parties, which may include advertisers. Depending on the circumstances, we may rely on your consent or the fact that the processing is necessary to fulfill a contract with you or to comply with the law. We will ensure that the reports do not contain any personal data so that the information cannot be traced back to you.

JET may launch specific campaigns or competitions in connection with its Services. Participation in JET campaigns or competitions is always on a voluntary basis. We may rely on your consent, unless your consent is not required under applicable law. 12. JET for Business

We process personal data when you use your JET for Business credit to pay for an order you placed through our Services, when using or interacting with JET for Business products and services, to redeem the JET for Business card to give and send and/or to provide you with digital credit. Depending on the circumstances, we may rely on your consent or the fact that the processing is necessary to fulfill a contract with you or to comply with the law. The following personal data may be processed in connection with JET for Business:

  • Name
  • Address data
  • Employment details (position, department, contractual hours)
  • Contact details
  • Credit information
  • Order and transaction information
  • JET for Business ticket information
  • Payment details

The JET for Business card works together with service provider Stripe for card issuance and card transactions, which is also qualified as an independent controller. Stripe’s processing of some of the above personal data is subject to Stripe’s privacy statement, which can be viewed here and we encourage you to read it as it applies in addition to this Statement.

Additional purposes

We will only use your personal data for the purposes described above. If we wish to use the data for another purpose, we will take appropriate steps to inform you, commensurate with the significance of the changes we make. Depending on the circumstances, we may rely on your consent or the fact that the processing is necessary to fulfill a contract with you or to comply with the law.

How we collect your personal data

We obtain, process and store your personal data, as well as data about devices you use to navigate to JET platforms (e.g. your computer, mobile or other means), which you provide to us by placing an order, creating an account or otherwise by contacting us.

We process personal data that you voluntarily provide, that we collect automatically and that we obtain from external sources for the purposes described in this Statement.

  • Personal Information You Voluntarily Provide: We may receive personal information from you when you place your order, create an account with us, or provide your marketing preferences or customer reviews in connection with our Services.
  • Personal Information We Collect Automatically: With your prior consent or as permitted by applicable law, when you visit our Platforms, we may automatically collect technical information about your equipment, browsing activities and patterns. We use this personal data by using cookies, server logs and other similar technologies. These machine learning algorithms generate content that they use to personalize your user experience, in particular selecting the items you are interested in, and to support the overall optimization of our Services. We may allow you to use social media sites to create your account or link your account to the applicable social media site. These social media sites may provide us with automatic access to certain personal data they hold about you (e.g. content you view, content you ‘like’ and information about the advertisements you have been shown or clicked on). .   • Personal Data We Obtain from Third Party Sources: We may receive personal data from third party sources including advertising networks and social media platforms such as Facebook or providers of technical payment and delivery services which may be located outside the EU. This may be for purposes such as supporting the procurement of our Services, to measure the performance of marketing campaigns for our Services, and to better understand your preferences so that we can tailor our marketing campaigns and Services accordingly. Where we have received such personal data, we have checked whether these third parties have your consent to process the information and whether they are otherwise legally permitted or required to share your personal data with us.

Age

Our Services are not intended for individuals who are defined as minors by applicable local law, nor do we intend to collect personal information from visitors who are under the established legal age. However, we cannot verify the age of visitors. Therefore, we advise parents and/or legal guardians to monitor their children’s online activities to prevent their personal data from being collected without parental consent. If you believe that we have collected personal information from a minor without consent, please contact us. We will then delete this data.

Automated decision making and profiling

Automated decision making occurs when an electronic system uses personal information to make a decision without human intervention. In the performance of the contract with you and/or to the extent necessary to fulfill our obligations or where necessary to improve our platforms and Services for our legitimate interest, JET uses automated decision-making and profiling. For example, JET uses your address details and/or location details to select available Partners in your area. We also use automated decision-making to comply with our legal obligations to prevent money laundering, terrorist financing and other criminal offences.

You will never be faced with decisions that will have a significant impact on you based solely on automated decision-making, unless we have a legal basis for doing so and we have informed you of this. If you wish to object to this type of processing, please contact us via our privacy form. We will then reassess the situation and/or provide you with more information about why and how such an automated decision was made.

How long we keep your data

We will only retain your personal data for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, tax, accounting or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we purposes by other means, and the applicable legal requirements.

In some circumstances we may anonymize your personal data so that it can no longer be associated with you; in that case we may use that information without further notice to you.

Sharing your personal data with Partners

If you order through our services, JET will share your personal information (order, name, address, telephone number and contact details) with the restaurant you have selected so that the restaurant can deliver your order and provide services where necessary, for example to resolve your complaint to solve. Partners may process your personal data to contact you if necessary to fulfill the contract with you.

You are a direct customer of the Partner and therefore the Partner bears its own responsibility and obligations for the processing of your personal data. For questions about how the Partner handles your data, we recommend that you contact the Partner directly.

Sharing your personal data in the context of JET for Business

If you use your JET for Business credit to pay for an order you placed through our Services or by using the JET for Business card, JET shares personal data (such as email address and information about your order and credit) for performing our contract with this person providing you with the credit (this could be your employer, business partner, etc.). Please note that the person granting you the credit has their own responsibility and obligations regarding the processing and protection of your personal data. If you have any questions about how your personal information is used by this business entity, please contact them directly. The person granting you the credit also shares personal data with us to enable us and the JET for Business Card service providers to provide services to you.

Sharing your personal data with others

JET may collaborate with other companies within the JET group and/or with other third parties to carry out the processing described in this Statement and/or to comply with legal obligations.

These group companies and third parties process your personal data on our behalf as data processors or as autonomous data controllers (or in a position defined or referred to as such under applicable data protection law, including concepts such as the equivalent of data controller or data processor), and have access to your personal data for the purposes described in this Statement. We require group companies and third parties to protect your personal data in accordance with the standards set out in this Statement and we take appropriate measures under applicable data protection law to ensure the same level of protection and confidentiality.

We may also share your information with other third parties where appropriate or required by applicable law or regulation (including a court order or request from a judicial authority) or where we believe disclosure is necessary to comply with legal requirements. obligations, to exercise, establish or defend legal rights or to protect the vital interests of a person.
